Partner Temporary (subclass 820) and Residence (subclass 801)

This is an onshore 2 stages temporary visa and permanent residency visa allowing the holder to live and work in Australia permanently.

Stage 1:

  • The two subclass visas are lodged together in a combined application.

  • The applicant must be in Australia to lodge the application and when the temporary visa is granted.

  • The temporary visa holder can live in Australia until the decision of the permanent residency visa.

Stage 2:

  • After 2 years since the application was made, the temporary visa holder may be eligible for a permanent residency visa to live in Australia permanently.

  • The applicant may be in or outside Australia when the permanent residency visa is granted.

Partner Provisional (subclass 309) and Migrant (subclass 100)

This is an offshore 2 stages temporary visa and permanent residency visa allowing the holder to live and work in Australia permanently.

Stage 1:

  • The two subclass visas are lodged together in a combined application.

  • The applicant must be outside Australia to lodge the application and when the temporary visa is granted.

  • The temporary visa holder can live in Australia until the decision of the permanent residency visa.

Stage 2:

  • After 2 years since the application was made, the temporary visa holder may be eligible for a permanent residency visa to live in Australia permanently.

  • The applicant may be in or outside Australia when the permanent residency visa is granted.

Prospective Marriage (subclass 300)

This is a temporary visa for the holder to enter and remain in Australia to marry the Australian citizen, Australian permanent partner or eligible New Zealand citizen partner.

  • The applicant must be outside of Australia to lodge the application and when the visa is granted.

  • The visa holder must enter and marry the Australian citizen, Australian permanent resident or eligible New Zealand citizen partner within 9 months.

  • After the marriage the visa holder can apply for an onshore partner visa to live in Australia permanently.
